So if he booted a back up game, then the chip would need to be on, meaning that the bios blocks live signing in.

Chances are, your account would not be banned, just your xbox.

this is only possible if you are using a stock HD, if you want to use an upgraded HD on Live youll have to get a new gamertag
and Dar, just use your original on Live like the rest of us

I guess to play a backed up game one need to leave at all time the mod on. One cannot just boot the game mod on and turn mod off then play LIVE.

I think you are a little mixed up. XBConnect and XLink Kai are two tunneling programs. Basically, they let you play system links games over the internet. They have nothing at all to do with Live. Completely different services. And the BIOS has nothing to do with it.
The reason the Xecuter BIOS was brought up is because it blocks access to Live... which is a good thing! You never want to accidently sign on to Live with your mod on, or you will get banned. An Xecuter BIOS will block your XBox from accessing Live so no accidents can occur, but you can still use XBConnect of XLink just fine. And, of course, you will still be able to use Live with your mod off... but with your mod off you won't be able to use any burned games or games stored on your hard drive. So in a nutshell, if you want to use Live you must be using original games and have your mod off (unless you wish to get banned).
