Virgin 360 + Old Hdd + Marriage Theory Question

I recently had to replace my old 360 due to the Red Ring of Death. When I got my new system, I decided to use the old 20gb HDD that had all my saves/content on it. I sold the new one on Ebay.
The first system I had was softmodded, however when the ban hammer came down I stayed off-line in fear (and lack of time) until the scene figured out what was happening. Well, the RRofD happened before the marriage theory and the rest of the speculation came into full play.
I have not connected my new softmodded 360 online yet. Looking at the marriage theory, I'm a bit confused. I plan to keep my 20gb HDD, but I'm worried that using the old HDD (which was never technically marked as banned) with my virgin 360 might result in a ban.
Has this setup been tested yet (using an old HDD with a virgin 360)? Is there a new marriage w/the EEPROM and HDD - or does an existing marriage last already with the old HDD on the Microsoft servers?
I have Halo III pre-ordered and want to make sure I can fully enjoy the game in a few weeks...I'll but a new HDD if that's the only answer before I go on Live..but I want to make sure of this.

if you don't want to get banned, don't mod your system. if you want to take a chance, minimize the odds of getting banned by using ixtreme 1.2.
also, you posted in the xbox1 section by accident. i'm moving you to the 360 section.

I fully understand that the best way to not get banned is to not mod or get ixtreme 1.2 - unfortunately my guy who did the FW upgrade is no longer around and I'm happy with what I have for now.
So to clarify - there is no marriage theory on 360? I've heard (on other forums) that when you initially connect to Live w/the 360 there is some authentication/handshaking which registers on the MS network - and once you change your FW - a flag is raised (unless of course you changed it before first signing into Live).
Sounds invalid according to you....?
