Perhaps Nintendo isn't making a console at all... rather they are just making Xbox2 controllers and games? It's a stretch, I know, but how damn cool would it be if they made a controller for Xbox2 games that dealt with touch feedback? Besides, they aren't "lying". Any good attorney would tell you that there is a fine line between lying and non-disclosure. Anything that isn't officially being brought to market does not have to be disclosed to the investors. It's a way to protect investments. R&D is very rarely included on quarterly reports and I think vaporware consoles fall under that umbrella.
As far as their console goes, they can still bring out the "revolution"... Xbox2 with Nintendo stickers. That's not lying either. Just bending the truth.
