Dash Update, live Options

yeah.. i got a new live kit today, and i go into update my dash with mech assault. (modchip turned off btw). it updates it, and then i go to new account on the dash, it says i need another update (im guessing 2.0), but the problem is it keeps saying xbox live not responding, please try again later..
the ip dns and gateway are all set up.
i dont believe im banned, but i cant check my xyz codes or anything as it just goes into the infinite loop of failed updates. ive tried over and over
theres a possibility it could be my router, but ive forwarded the ports and all.
i searched for it and all i can find is stuff about the busy launch of 2.0,
but i believe that was some time ago

so is it my router, am i banned, is the server busy?

edit: my router wasnt forwarding the ports before today, and my xbox had never been set up for xbox live before, however evolutionx dash had been set up correctly (ip gateway and dns)
