Second Class Action Lawsuit Filed against Microsoft for Scratched Discs
Posted by XanTium | July 19 18:27 EST | News Category: Xbox360

From next-gen.biz:
[QUOTE]
Two Californians have filed a class action suit against Microsoft alleging the Xbox 360 is prone to scratching discs.

The class action seeks no less than $5 million in damages.
The suit says "Microsoft improperly and/or negligently manufactured the Xbox 360 console in a manner that causes the expensive game discs ... to be scratched, rendering the games unusable."

Microsoft was hit with a similar lawsuit in Florida last week. Microsoft denied the allegations.

Its really pathetic when people try to sue Microsoft for bogus reasons. The 360 console does scratch discs. The very thought is nonsense and ridiculous.

I really wish these two californian idiots would be thrown in jail for filing frivalous lawsuits and wasting the court's time.

Speak not of things of which you know absolutely nothing about.

My console never moves from its place in my entertainment center. I'll play a game all the way through from start to finish over the course of months. (I don't get to play very much). Some discs have gone in brand new and then come out with scratches. I rarely swap discs and I always handle them by the edges and center ring.

Discs don't scratch themselves. Many 360s *can* and *will* scratch discs.

I wouldnt say this is a bogus reason. maybe you were lucky enough to get a console that doesnt scratch discs, but i keep my 360 horizontal and never move it and it scratched 2-3 of my games. that console also died and i sent it in and got a new one that has yet to scratch a disc. microsoft definitely should be accountable for things like this.

yeah but not for $5 million bucks. Just replace the systems and the games. Even then, it's kind of a hard thing to prove unless they are willing to sit there in court with the 360 and actually play games on it to see if it will scratch the disc. You need some kind of evidence and word of mouth doesn't really cut it in court.

Are they even entitled to anything since M$ has had the game exchange program running for a while?

the PS2 is designed to be placed vertically and horizontally so is xbox360. if you move the PS2 from vertical to horizontal it does not scratch disc while playing. the funny fact is: every new xbox360 from box has a sticker telling user not to move the console while playing.

i reckon ms does need to review the design of the dvd rom. not only disc scraching but also the problem with the samsung drives being unable to eject known as the magnet is too strong for the motor to drive the tray via a rubber belt. actually the same problem existed in the samsung drives for xbox1. surely ms does not know/care what has been going on. are their service centres required to feed back those info?

ms did great job on the security to protect the console . sadly they did not pay the same attention to the hardware design.

It's a given you never move something electronic with moving parts in it while it's in operation. The discs scratched for this reason are not M$'s fault.

Neither is the disk scratching in general. It's the dvd manufacturer's fault, for not putting in proper preventive measures to prevent the disks from being scratched.

Although M$ does need to rethink who they're buying dvd drives off of.

Yeah, the samsung drives were found to not have any anti disk scratching protection. This, combined with security issues with the samsung drive are 2 possible reasons why you see more Hitachi-LG and Benq drives on the market today than Samsung drives.

thers been alot on this for a wile now. but proving the diffrence between user error and a defitiv box is relly hard. and it defently doesent effect all consoles sence mine has never wasted a disk. but then again i got pretty lucky when i got my 360 no disk scraching no rod. guess i got one of the good ones.

they had that, but you had to pay for the disc I believe. Why should you have to pay for something you didnt mess up. My brothers launch console scratched his COD2 and it just sat horizontal in the entertainment center.
