Halo 2 Betrayal?, why can i not kick people? Options

hey, when i play halo 2 on my xbox (retail copy of the game) and i use klink kai to play onlin whenever i get betrayed i cannot kick the person, even if they do it multiple times. but if i betray anyone they kick me. does anyone know a reason for this? also does anyknone know if there is a hack that lets you kick someone without them betraying you? because sometimes i get kicked for nothing...
