I purchased an xbox over the weekend at a garage sale for my son, it had retail games and backup games. We were able to play both types of discs with no problems, on Monday my wife decided to play a game with my daughter and it wasn't working properly it seems my daughter was pressing any button availablel to get it to work. When my wife came to see what the problem was she noticed thee was an option to play from DVD and selected it. When my son returned from school he wanted to play with it but the xbox wanted to connect to xbox live, I have been trying to get around that but it just keeps coming back to the same screen. If I put in a retail disc and turn it on it will play with no problem, when I put a backup disc in I get the xbox live is not responding.

This is what happens when i turn it on:

Step 1.Boot Up...
2.Very first loading animation plays (of green blob)...
3.Big green Xbox logo Appears... Shortly followed by small "Microsoft" text underneath it...
4.Then goes straight to "Xbox Live is not responding please try again later"...
5.I Press OK, puts me straight back to Step 4.

I am totally green on game consoles, modding etc.. so I may ask a few dumb questions:

1) should I connect the xbox to my home network?
2) Is the xbox modded? if so how can I fix it

Bad news. Your Xbox was softmodded with an old, poor, or badly installed softmod, and now it isn't modded at all.

Try to ask the seller how it was modded, and if they used a gamesave, which game. Your quickest route to fixing it is to run the game used to mod the Xbox in the first place, and hope that the gamesave is still there.

Failing that it is still fixable, but it will be more work.

The perosn is away at school, can you direct me to instructions on how to do the repair or replacement of the soft mod?

You don't need to quote the immediately preceding post.

Here's what you do:

1. Run a post 2004 Live-enabled game (Halo 2 or later) and go through the process of signing into Xbox Live. You don't need to be connected to anything, the first thing the game should do is update your dashboard. Once it's done that you can quit the game - no need to go any further.
2. Buy a copy of Splinter Cell.
3. Download the Krayzie 1.1.1 gamesave softmod installer. You have to Google for it, links to softmods aren't allowed here).
4. You need a mechanism to get a softmod installer onto the Xbox. You need Xplorer360 beta 6 (Google for a download), plus either:
a. a USB stick that the Xbox will recognise (<4GB, not all work so there is some trial and error) and an Xbox to USB adapter.
b. An Xbox memory card, plus access to an existing modded Xbox to transfer the gamesave to the card.
c. An Xbox memory card, plus a controller modded to have a USB connector.
5. Plug the memory card or USB stick into the Xbox, and try to access it. The Xbox will format it for you.
6. Plug it into your PC, and use Xplorer360 beta 6 to copy the numbered gamesave folders (5553000c and 21585554 for Splinter Cell, 4d530017 for Mechassault, and 4541000d for 007-AUF) to the root of the memory card.
7. Plug the memory card back into the Xbox, and copy the gamesaves onto the Xbox hard drive.
8. Run the game, load the gamesave, and the softmod installer will launch.
9. Backup the eeprom as instructed, then select "Basic Install - UnleashX Dashboard" and follow the instructions.

Great news.. sort of... I went digging trough what we got and came across Spinter Cell retail disc. I inserted it and then turned on the xbox, it went through the game, when I went to play the game it gave me an option to load a profile, so I picked LINUX, it launched me into UNLEASH X, can you guide me to what I need to do to get it working? My wife did mention she clicked on the "launch DVD" option in this screen when they were having problems running my daughters backup game.

Thats lucky you should be back up and playing in no time, been a while since i have done it but i think when in unleashx there is hit A to install the softmod and then backup your eeprom before continuing ?
A search here should give you the correct steps to take.
