Right:

Sale of Goods Act = (basically) if the product is sold to you in a broken state (even when outside the warranty) it should be replaced.

Well we all know there are no 'working' 360 Dpads - so surely all are a potential legal minefield under this UK law.

E.G: 1 year & 1 month, outside of my warranty, my 360 breaks & I claim that Ive just noticed my xbox pad is faulty (when trying it out on my replacement system/my mates one etc...). Its always been faulty (as can be proven by buying a new pad). As the pad was part of the original bundle; the original bundle was faulty at purchase: therefore do I not have the ability to demand a refund? - Given that this act covers me for 6 years from buying faulty goods?

Just a thought.... - Ive asked Nelson on xbox.com too.... Ill post if he replies tongue.gif

How are they faulty?
As in they don't work at ALL?

And I don't think that would be correct. If anything they would replace the controller... not the entire bundle.

They all have faulty dpads. And you could reasonably never have used it within a year.
I know it would be logical to replace the controller not the bundle, but law is far from logical, and all you have to do is prove that the good was not sold in as described, or in a fit state. I bought it as a package, which was not complete/as I had imagined......
Just wondering if anyone knew anything more accurate - anyone study UK law?

not good and not working aren't the same thing. the dpads technically work, they just aren't the super high quality dpads everyone was expecting. a faulty dpad would be if it just flat out didn't work. up, down, left, and right, and the diagnals all work on the 360 controller. have fun pleading your case against the best lawyers in the world if you try to pursue this (i'm talking about the MS lawyers)

I thought it was 3 years in Scotland and 2 years in England. Also you have to prove it was faulty at the time of purchase.
I had to do this training for work (PCWORLD) so that I could rip off customers. I'm sure it is only 2 years in England and with no way of 'prooving it' you will not be legally entitled to a new pad.
