In Holland we have something known as the right to have a home-copy of some copyrighted content. Only for personal use. Otherwise it's violation of ©. Ask a local jurist.

You would still need to access the Xbox physicly anyway for reboot to dash/FTP server. And you need to write an FTP server from scratch without using XDK libs.

XBE exploits (softmod) are _probably_ legal. Rmenhal's nkpatcher is _probably_ legal (for F drive hack and prevent from having to sign each XBE with font exploit). Again ask your local jurist for the laws on circumventing security in software.

There is no legal bios that can boot XBE's but the one in your TSOP
You really need to check with Jurist-Scene, not Xbox-Scene.
