Lie, tell them sporatically the drive won't read. This would mean it sometimes fails, sometimes works. This way if they can't reproduce it they will just replace and ship it back to you. Thus further testing it. No way they would spend more than 30 mins testing it anyway.

And tell them it was working fine for the first few days, then started to sound louder and louder and that's when the problems started.
