some guy on a other forum got banned to.. be he has a completely LEGAL XBOX360

I just got banned as well after halo 3 beta... I am using an original store-bought retail disc of crackdown, downloaded the halo 3 beta using it, got to play for about 3 hours then banned.

I am also not using a modified dvd-drive or firmware hack at the moment. I did used to use a hacked Hitachi 47 drive with FW 2.3 before the Spring update. Admidst all the ban talk I decided to flash back to original firmware and not use back-ups for a while. I did this before the Spring update.

I now get the banned message when doing a network test (note when you do a network test you only see the banned message in "More Info" under Network Adapter or IP, not under Xbox Live).

This means that either MS have been logging people playing back-ups for a while, even before the spring update, or there are indeed false bans happening as some people are reporting. I know there were a lot of false bans with GoW when that came out, and poeple were let back on after a few days. I hope that's the case this time!******

Has anyone tried restoring there firmware back to stock and tried to go back to Live? ..I'm at work so I can't try but I will once i get home.

So far it seems that the only people being banned are those whom play burned games on Xbox Live. It is then clear that Microsoft is prehaps unable or unwilling to detect the modified firmware.

This makes sense since every games is supposed to be unique piece of software.

mine is ok so far ive got a sammy with 5.3c i downloaded halo using crackdown copy and played halo for 30 mins and all ok so far or maybe they just aint got to me yet ive deleted my halo 3 and crackdown saves to see if that makes a diferance

When is a console checked to see if it's modded or not?

I've connected to XBox Live to download demos and a few trailers (with the silver membership), but I've never played online.

However, I have left the ethernet cable plugged in when playing backups, and it says logged in to live, and asks me if I want to download an update for the game and I say No.

yup no sympathy (for Microsoft) here either now some people really aren't going to buy the games and not buy another 360, no XBL, and might just pick up a PS3. What about all the people that don't have modded FW and still face these issue no sympathy right? Doesn't pay to be legit either if you still get banned does it.
