Should I Risk Going Back On Live? Options

So I was playing halo 3 when the servers crashed, an hour later right before I was going to play again I read about people getting banned. Now I really would like to find out if i've been banned (maybe its a time ban and im already on the list to get banned so might as well???) and it would be nice to play halo 3 again, should I risk going online or wait it out until there's a "fix" or new developments?

your console has more than likely already been logged & been banned,suppose only way to find out is to try out xboxlive,luckily mine had the 3rod but was still using it on xboxlive by temporary fixing by doing the towel trick now they have banned my knackerd console,My next plan is to go out & buy a new console,put my knackerd one in the box then take the knackerdd one back to the store & ask for a exchange or a refund due to the console not booting any games,I'll have a reciept,they should just swap it so should end up with a refund or another xbox360 i wont mod one just use for xboxlive
