Microsoft resolves lawsuit over Xbox Fall Update
Posted by XanTium | August 3 16:05 EST | News Category: Xbox360

From blog.seattlepi.nwsource.com:
[QUOTE]
Microsoft has reached a resolution in one Xbox 360 lawsuit. The latest court filing in the case of Kevin Ray v. Microsoft Corp. (PDF, 3 pages) indicates that the two sides have agreed to dismiss the case. Ray's lawyer, Darren Kaplan, said via phone Friday that the case has been settled, but the terms are confidential.

Ray's suit focused specifically on the Xbox 360 Fall 2006 software update, alleging that it caused his Xbox 360 and others to stop working. Although the case was filed as a proposed class action, the two sides agreed to settle it as an individual action. That means it won't apply to anyone else.

The settlement of the Ray lawsuit isn't the end of the Xbox 360 litigation. In particular, Microsoft has recently been the subject of several suits over alleged disc-scratching by the console. Ray's lawyer, Kaplan, is also representing a plaintiff in one of those cases.

He was blaming the RROD on the Fall Update? Usually I'd take his side but he really needs to research that more.

Now if his 360's power got interrupted while he was updating and then it failed to boot due to newly burnt efuses, I'd take his side.

He probably just got a new 360 Elite, some free games and a trip to TGS or something. There's no point filing lawsuits again MS, MS have some of the best well payed lawyers in the world (in fact a whole team/department of them so I believe).

Having more lawyers does not change the facts of the case or the law. Corporations hire a number of attorneys based on necessity like much of the rest of their staff. Many attorney offices do as well. Those that get a higher number of cases need more attorneys to work them. Ultimately, though the merits of the case will speak most loudly about the outcome. Bear in mind, most cases don't go to trial. They are usually settled out of court. Attorneys that handle these types of cases usually play more of a negotiating role than anything else...

I doubt he even got that. MS is not afraid to back down and of course they hire some of the best. Seriously though this needs to stop. It is only for greed and people are too dumb to stop. I say get a life and join the rest of the working class of america.

yep, sounds strange to me too, "confidential deal" and "two sides agree to dismiss the case."

hopefully he settled with enough to pay the legal fees and then some...

this type of lawsuit needs to become a class action for the betterment of the consumer protections of the 11.5M 360s sold.

i doubt the guy got a lot of cash but this sure did save ms a ton.

M$ probably said, 'drop the case, or we'll have the feds all over your ass for downloading music or games or whatever.' Straight up blackmail would be my guess.

i'd say he got a handsome payout, it would take alot of balls to take m$ to court with no evidence, m$ would have given him some hush money to keep the information he has under his hat.

if i had any sort of evidence, it would take more than an elite system or extended warranty to keep me quiet. but i would take a couple of million to keep me satisfied!
