I just looked at the Best Buy Sunday flyer, and they have H3 on sale for $38 this week (til saturday night). This might be the time to buy that second copy for your other 360, or to just have one as a legit backup.

I might actually jump on this one as this is one of those games that MS will probably leave at $60 for the life of the system. They are still selling Halo 2 for $30 everywhere you look.

I also saw that you can buy it online from Best Buy with free shipping if they are out of stock in store. When I went to buy a copy at my local best buy, they were out of stock. One guy told me that they didn't do rain checks, but they did give me one at the customer service desk, so be persistent or buy it online.
