So what was the defense? It seems to say the defense was the copyright infringement happened before a modchip was sold? Aren't they just giving a new target as those that break the code to allow modchips? Maybe I'm just reading something wrong.

UK law are stupid, by "law" games and musics cds you can't even "RESALE" (E.G. this is what it reads back of my Resistance PS3 box 'RESALE AND RENTAL ARE PROHIBITED UNLESS EXPRESSLY AUTHORISED BY SCEE'), so why don't they go and close down Ebay sleeping.gif

true same goes for copies of games that come with a elite bundle i can't even trade them in fucking game stop!

I would usually be happy about this but because its Mr Modchips thats involved i'm quite dissapointed he got away with it. Mr Modchips is the worst company i have ever purchased anything from, there are tons of complaints all over the net regarding the way he treats customers and in this business its quite unusual to get such bad service, especially since the customer base is small.... i remember loads of problems with people being banned from his support system for requesting refunds when team xecuters blaster 360 was released.
So basically this is good news regarding mod chips but i cant say i'm happy to see mr modchips continue trading.

I'm with beasty on this one, kind of pleased about the modchips thing but its ruined by the fact mrmodchips was involved. Don't think for one minute that he was doing it out of some ideology or for a cause he was trying to save his own skin, the guy is a crook and a weasel and I'm gutted that he won't be getting raped in prison.

Agree wholeheartedly with the comments here - great that justice has prevailed, but gutted there isn't a law (in the UK at least) against being a tit. Mr Modchips is a terrible reseller: dishonest, rude and generally not a nice person. Hopefully karma will get him.

There's a saying...

"The Enemy of my Enemy is my Friend"

Mr Modchips my be a jack-hole in terms of customer service but I'm not about to let a personal grudge with him completely ruin the legality of modding.

Backing up a MrModchips on an issue like this is basically putting aside your differences for the greater good.

if someone stole $100 out of your wallet and the next day this person needed your help to save the life of a mutual friend would you say "no, screw you" or would you temporarily set aside your problem to help save the friend and then deal with the $100 later?

If he was on trial for ripping people off... then by all means throw him to the wolves, but he was on trial for something that effects ALL MODERS and in this regard we should treat him as a fellow moder for the good of all moders.

Casting personal opinions aside, this is fantastic news for the modding community. By arguing that the modchip is just the device for which software can be ran from sets a massive precedent in the UK. By all standards, modchips should now be legal over here.

Well done for sticking it to the man!
