Microsoft Sues DHL After Train Dumps 21600 Xboxes
Posted by XanTium | October 10 22:53 EST | News Category: Xbox360

From pcworld.com:
[QUOTE]
Microsoft is suing U.S.-based cargo-delivery service DHL Express for allegedly losing 21,600 Xbox game consoles because of a train derailment in Texas, according to court documents.

In a complaint filed in the U.S. District Court for the Western District of Washington in Seattle, Microsoft said it is seeking more than US$2 million in damages from DHL for two containers of Xbox consoles that sustained "impact damage, wetting, pilfering and shortage" after a derailment near Duke, Texas.

The Xboxes were en route from a Microsoft office in McAllen, Texas, to Long Beach, California, for eventual delivery to Hong Kong at the time of the loss, which occurred on Oct. 13, 2007, according to court papers. Flextronics Industrial in Hong Kong was the intended recipient.

Microsoft claims that DHL has refused to compensate it for the loss, even though the delivery service "negligently breached its duties as a common carrier, handler, bailee, warehouseman, agent, or in other capabilities," according to the court papers.

Don't get me wrong, I like DHL more than UPS although FedEx is my favorite. But for them not to pay up is pretty lame. Surely the cargo was insured so how could they deny to pay?

If MS is taking it to court, which they are, they in all likelihood have their lawyers saying it's an easy win.

Right. At the current price (assuming they're all Pro 360s), that's nearly $6.5 million worth of 360s. I'd say $2 million is a more than reasonable request.

Guess that's what happens when you get the cheapest shipping possible wink.gif

Honestly though, I've never had a problem with DHL.

UPS might be slow as molasses, but they haven't ever destroyed my package. I've had DHL destroy numerous packages during shipping and act like their shit doesn't stink. I hope they get ordered to pay every red cent.

FedEx ftw.

never had any problems with a courier service, only with regular mail services, but it's pretty lame DHL doesn't pay up, sure the contents of their wagons get insured.
besides, they failed to complete their service according to the set conditions, so it's more than normal they pay up.

LMAO. I was gonna say "DHL - Picking up where the RRoD left off" tongue.gif

And whoever says FedEx is good is lucky. I've had more packages come up missing and/or sent to the wrong address with them than with all others combined. They'll leave stuff at the door of an apartment complex (c'mon now, people steal things) without a signature or anything. One time they even said they attempted a delivery, when I was at the house waiting on them (all day, I might add). At 3:30 I saw the tracking info updated and ran out to their distribution center before my package disappeared.

Now why would MS be sending 21,600 consoles TO Flextronics... I can think of three reasons, all three of which are red and flashing.

Are they seriously claiming DHL broke 21,600 broken Xboxes that were on their way to the factory?
