I added an "Action" action script submenu at the end of my Menu.xml file and everything worked BUT the menus are out of order.

I had
"Applications"
"Emulators"
"Games"

After adding the "Action" submenu to at the end, it showed up in between Emulators and Games.

"Action"
"Games"

How can I fix it so it shows up AFTER games?

Maybe and EndSort tag after the Emulators node will fix this

Yes, I'm thinking it's an issue with the sorting tags used.
