Difficult to say, except that ANY modchip that comes pre-programmed (Xecutor 1, Xecutor 2 Lite etc) with a non Linux bios is probably illegal anywhere (even australia). A blank mod chip, or one which comes with the Linux cromwell bios is probably ok (though that may have to be proven in court like it was in australia) as long as you don't use it for playing pirate games.

As far as I know,
nowdays all cheapmods can be programmed with Linux Bios,
and thanks to OzXFlasher that is available to download it at www.ozxchip.com
you can flash it with any 256Kb bios you want!
The way of programing it is much better than X2 PRO or Matrix,
as it doesn't require a PC to use,
but only your Xbox modded with the cheapmod!
So I guess that there is no problem doing bussiness with cheapmods...

if you can prove to the judge that its primary use is not piracy then its i guess legal.
should be somewhat similiar to the case against dvd-jon in norway about decss?
dont know if any cases made it to the court yet though..
