Are you running them off a chip/tsop or via a softmod (exploit)?

yes you can but only with the chip on, you wont be able to play xbox live because to boot standard you have to be able to lock the hard drive

So if I booted up M8 BIOS form my modchip and my hard drive happened to be unlocked, I could play the games without a #5 error but I just couldn't play Xbox Live?

yep! and of course you need the dashboard as well to do anything. you may have that already I don't know
