I'm concerned that I will get the ban hammer next time I login. I have some items in my download queue that I've already paid for. If I take my hdd to a friends un-modded 360 will I be able to download the content and bring it back to my machine? And my friends console, no repercussions for him? Thanks.

It won't work. If you sign into your gamertag on your friend's console and download a game to your hard drive, when you connect your hard drive to your console, the game will only work if you're signed into Live with the gamertag that downloaded it, otherwise it will revert to being a demo. Obviously, if your own console is banned, you wouldn't be able to sign into Live in order to play the game, so it's not a solution to your problem.

Darn it, is there any way for me to get my queued downloads? I'd sign on now but obviously I don't want to lose the functionality of my hard drive if I'm banned as soon as I log on. Last time I attempted to logon was Oct 28th and MS wanted me to download the mandatory dashboard update. Thanks.

The only thing you can do is risk logging in to download the queued content. Either that or stay offline and forget about the games you paid for. The way that downloadable content is licensed doesn't give you any other options unfortunately mate, because if you use any other console but your own to download them, you will have to be signed into Live every time you want to play them.

I'm kind of in the same boat as you, although I haven't got any games queued up. If I stay offline, I might not be banned. If I go online and find that I am banned, well I really don't want to lose the ability to install to the hard drive either! lol. It's a catch 22.
