Im wondering if I can plug in the network cable fast and see if im banned then take it out. But if I do this fast can I get flagged?

Probably. You may even get flagged while offline. Nobody knows...

T-E has run a test and it seems that if you have flashed the firmware then uploaded the recent two or three updates from XBL THAT'S when it it gathers the information and the flag comes later. Sorry to repeat this for an older post but it's relevant.
